Statement of waiver and disclaimer

I wish to participate in the Tour CIBC Charles-Bruneau, a cycling event in support of the Centre de cancérologie Charles-Bruneau and pediatric cancer research that features nine itineraries (from 50 to 600 km) and takes place on June 6 and from July 5 to 10, 2020. I confirm that my participation in the Tour is voluntary, and I shall undertake to comply with the rules, regulations, and guidelines related to the Tour, and with all applicable regulations and laws.

I understand that my participation in the Tour, including riding on streets and public roads and using any service made available to participants during the Tour, is a potentially dangerous activity that could lead to serious or fatal injury. I am aware of the dangers and I assume all risks associated with my participation in the Tour, including the risk of falls, collisions and contact with vehicles, other participants, pedestrians and objects; the risks associated with weather and traffic and the road conditions on routes used by the Tour, and any defects in my bike or equipment, regardless of the cause.

By registering to take part in this event, I hereby waive any and all legal proceedings for injuries or damages I may sustain or that may occur during or resulting from my participation in the Tour (including any activity preceding or following the Tour), and I exonerate from liability related to these injuries or damages the Fondation Charles-Bruneau, the Canadian Imperial Bank of Commerce, all sponsors, official members, other participants, third-party suppliers, and all public entities as well as their respective affiliates, successors, directors, administrators, employees, volunteers, agents and representatives.

I intend, by this Declaration of waiver and release of liability, to exonerate in advance all persons mentioned above from any and all claims for damages of which I may be a victim in the future as a result of my participation in the Tour, even if such a liability was due to negligence, recklessness or carelessness on the part of the persons or entities discharged by reason of the use of dangerous or defective goods or equipment maintained under their control, or under their responsibility regardless of fault. I understand and agree that this waiver and disclaimer is binding upon my heirs, executors, guardians and legal representatives.

I hereby certify that I have the mental and physical abilities and have been sufficiently trained to complete the Tour. If I am aware of, or if I am being treated for, any physical disability or illness, my physician has been notified and has approved my participation in the Tour. I acknowledge that I am personally and solely responsible for my own health and safety, as well as personal items that I will bring, including, but not limited to, any bicycle or cycling equipment.

I agree that my participation in the Tour is subject to the sole discretion of Tour organizers and that my participation may be limited or terminated with or without cause.

I declare and certify that I will be at least 18 years of age at the time of my participation in the Tour. All Discovery Trek participants aged 16 and 17 must provide a declaration from a legal representative.

I understand that all donations received by the Fondation Charles-Bruneau, including all gifts I have made or applied for, are non-refundable and non-transferable, even if I do not participate in the Tour.

I grant permission to use, without compensation, my name, photo, voice or likeness in any reportage, promotional advertisement or other account of the Tour, or for the promotion of similar or future events of the Fondation Charles-Bruneau. I waive any privacy rights I may have in this regard.
